Terms of Service & Policies for

Our goal at Modern Inconveniences, LLC (DBA Web Pages That Sell) is to provide the best service possible and to do our best to fulfill your needs and meet your goals. This purpose of these Terms of Service is to act as a reference point for business engagement between Modern Inconveniences, LLC (DBA Web Pages That Sell) and it’s clients. This also serves as a reference point for policies and liability release. Typically there will be a signed contract between the two parties. In the case that there is not, these Terms of Service will be used as the binding contract. By doing business with Modern Inconveniences, LLC (DBA Web Pages That Sell) the client understands and agrees to these terms.
Hours of Operation
Modern Inconveniences, LLC hours of operation are on Monday through Thursday from 9 AM – 3 PM.
Service Level Agreement
When hiring Modern Inconveniences, LLC (DBA Web Pages That Sell) there will be communication by phone, email, text, or Facebook. You can expect to get a response within 2 business days. In the case that there is a extended period of time that the owner, Rebecca Metz, will be out of the office you will be notified within 1 week of that absence. This service level agreement is in effect during the term of the contracted time. (For example, if your web site project is finished or it is on hold, Modern Inconveniences, LLC (DBA Web Pages That Sell) is not required to notify of an extended time of absence or to get back to you within 2 business days).
Return and Exchange Policy
The Returns and Exchange policy for Modern Inconveniences, LLC (DBA Web Pages That Sell) is as follows. When initiating a website project we require a non-refundable deposit to commence work. Once work has commenced, there there is a NO REFUND POLICY for any reason. Exceptions to this policy can be waived at Modern Inconveniences, LLC (DBA Web Pages That Sell) discretion.
Modern Inconveniences, LLC (DBA Web Pages That Sell) understands that sometimes circumstances beyond everyone’s control prevent a project to continue. In this case your project will be put on hold for a duration of 6 months. If at that time you are still unable to continue with your project then there will be a service charge of $195 added to continue the project. Exceptions to this policy can be waived at Modern Inconveniences, LLC (DBA Web Pages That Sell) discretion.
In the event an appointment is canceled by Modern Inconveniences, LLC (DBA Web Pages That Sell), all students and clients will be notified and full refunds given.
During the course of our time we will have several live meetings whether on phone or in person. The client agrees to show up on time and prepared. In the case that the client is more than 10 minutes late, the meeting will be cancelled and the time is forfeited. Exceptions to this policy can be waived at Modern Inconveniences, LLC (DBA Web Pages That Sell) discretion.
Modern Inconveniences, LLC (DBA Web Pages That Sell) asks that the client makes every possible attempt to keep the scheduled meeting. If the meeting must be rescheduled, 24 hours notice is required. Exceptions to this policy can be waived at Modern Inconveniences, LLC (DBA Web Pages That Sell) discretion.
The value for each session is as follows:
- Website project initial strategy: Value: $450 (US).
- Education Session 1 hour: Value $197
- General walk through, follow up, clarification, miscellaneous: Value: $125
What do both parties agree to do?
The clients have the power and ability to enter into this contract on behalf of your company or organization. The clients agree to provide us with everything that we need to complete the project including text, images and other information as and when we need it and in the format that Modern Inconveniences, LLC (DBA Web Pages That Sell) asks for.
Clients agree to review our work, provide feedback and sign-off approval in a timely manner.
It is extremely important that clients share with us what your goals, likes and dislikes are with us so that we can incorporate that information into your work.
We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner.
Along the way we will endeavor to meet all the deadlines set but we can’t be responsible for a missed launch date or a deadline if the client has been late in supplying materials or have not approved or signed off the work on-time at any stage. On top of this we will also maintain the confidentiality of any information that you give us.
Website WordPress Template Design
Projects will be set up on the WordPress platform. We will test all our work in current versions of all major browsers including those made by Google, Apple, Microsoft, Mozilla and Opera.
The foundational theme is Genesis. We will not test these templates in old or abandoned browsers, for example Microsoft Internet Explorer 5 or 5.5 for Windows or Mac, previous versions of Apple’s Safari, Mozilla Firefox or Opera unless otherwise specified. If you need to show the same or similar visual design to visitors using these older browsers, we will charge you at the hourly rate of $65/hour.
It is important that you are aware that web sites can look different on different browsers and computer monitors.
Clients will supply us photographs either in digital or printed format. Clients may choose to buy stock photographs and we can suggest vendors of stock photography. Any time Modern Inconveniences, LLC (DBA Web Pages That Sell) spends searching for appropriate photographs will be charged at $65 per hour. Modern Inconveniences, LLC reserves the right to refuse the use of any image if we believe that the image violates copyright laws/infringement. The Client agrees that all images used in their work has appropriate license and use requirements met.
The client may already have professional web site hosting; they might even manage that hosting in-house; if that’s the case, great. If the client doesn’t manage your own web site hosting, we can set up an account for you at one of our preferred, third-party hosting providers. Updates to and management of that server, plus any support issues will be up to you. If you do require help with anything beyond the design and development of your site, we’ll be happy to help and will charge you $125 per hour.
We can’t guarantee that the functions contained in any web page templates or in a completed web site will always be error free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place. In the case that there is a dispute that cannot be addressed between the two parties and the case needs to be handled with the judicial system, the case will be addressed in the state of Minnesota and Hennepin County.
Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction of United States courts.
You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by you or that you have permission to use them.
Showing Off Your Site
We at time Modern Inconveniences, LLC (DBA Web Pages That Sell) love to show off our work and share what we have learned with other people, so we also reserve the right to display and link to your completed project as part of our portfolio and to write about the project on web sites, in magazine articles and in books about web design.
